If I stop being a volunteer for SPOT for any reason, or upon SPOT’s request at any time, I will promptly return all of SPOT’s supplies, equipment, records, moneys and other items, in good, clean condition. I fully understand the meaning of the word “volunteer” and agree to provide my services to SPOT in a volunteer capacity without any express or implied promise of salary, commission or payment of any kind whatsoever and without any employment-type benefits, including but not limited to employment insurance programs, workers compensation accrual in any form, or sick, holiday or annual leave time. I agree to be supervised by a SPOT director or designee as needed or specified, and will work as a team member with all staff and volunteers in SPOT and in other animal welfare organizations in a courteous and professional manner. I agree to treat all animals, other volunteers, staff and the general public with dignity and respect. I assume the risks of being bitten, scratched, injured, made ill, or frightened by dogs, puppies, cats, and/or kittens in connection with my volunteer work for SPOT. I hereby for myself, my heirs, administrators and assigns, fully, irrevocably and unconditionally release and agree to hold harmless SPOT, its individual members, and any venue at which SPOT may hold an adoption event, or fund raising event, including but not limited to, PetSmart, Petco, and Kahoots, from any and all known or unknown, anticipated or unanticipated, suspected or unsuspected and/or fixed, conditional or contingent, actions, causes of action, charges, suits, debts, demands, claims, contracts, covenants, liens, rights, liabilities, losses, royalties, costs, expenses (including, without limitation, attorneys' fees) or damages, including but not limited to any illnesses, medical costs, damages to property, persons or other pets, of every kind, nature and description, at law or in equity, in connection with or arising from any action or failure to act on my part or the parts of others while I am volunteering for SPOT, or for any negligent act or omission by SPOT. If I fail to abide by the terms of this Application & Waiver or if I am otherwise unable to meet the requirements of the volunteer program, which are subject to change from time to time, I understand that I will be terminated from the program. I also understand that I may at any time be removed from my position as a volunteer by action of the board of directors, and that I will be notified in writing or email should that occur. Any dispute arising between the parties with respect to this Waiver and Agreement shall be submitted to binding arbitration under the commercial rules of the American Arbitration Association then in effect. The venue for such arbitration shall be the County of San Diego, California. The parties agree to submit to jurisdiction and venue in San Diego, California for purposes of such arbitration.
